TERMS OF USE FOR BRAINRANK

Digital Den LLC ("we", "us", "our") provides BrainRank (the "App"), a gamified cognitive assessment platform that produces a BrainRank score, percentile ranking, and 6-domain cognitive strengths breakdown after a short adaptive test. By downloading, installing, or using the App, you agree to these Terms of Use ("Terms").

1. ACCEPTANCE OF TERMS

By using BrainRank, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not download or use the App.

2. ELIGIBILITY

You must be at least 13 years old to use BrainRank. If you are between 13 and 18, you should use the App only with the involvement of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

3. LICENSE TO USE THE APP

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use BrainRank on devices you own or control, for your personal, non-commercial use, subject to these Terms. This license does not transfer any ownership of the App, its code, design, scoring methodology, or any related intellectual property to you.

4. USER CONTENT

4.1 Ownership

You retain ownership of the content you provide through the App, including your test responses, optional profile information, and the resulting BrainRank score and cognitive breakdown derived from your inputs.

4.2 License Grant

You grant us a limited, worldwide, royalty-free license to use your test responses and profile data solely to operate and improve the App's features — for example, to compute your score, render your shareable score card, present your historical trends, and generate personalized recommendations. We do not independently commercialize your content and we do not use it for advertising targeting.

4.3 User Responsibility

You are responsible for the inputs you provide. You agree that you will not provide content that infringes the rights of others, violates the law, or is intended to harm or harass anyone. You also agree not to share or attempt to share account credentials, or to take the test on behalf of another person.

6. SUBSCRIPTIONS AND BILLING

The App is currently free to use. We may introduce paid features in the future, with terms (including pricing, billing cadence, free trial behavior, and refund handling) communicated in advance through the App and through the applicable app store at that time.

7. INTELLECTUAL PROPERTY

The App, including its code, design, branding, copy, scoring methodology, question content, score card templates, and all other materials (excluding the inputs you provide), is owned by Digital Den LLC and is protected by intellectual property laws. The "BrainRank" name, logo, and visual identity are trademarks of Digital Den LLC. Nothing in these Terms transfers any ownership of those rights to you.

8. DISCLAIMERS

BrainRank is provided "as is" and "as available", without warranties of any kind, express or implied.

BrainRank is intended for personal interest, self-reflection, and entertainment. Your BrainRank score and cognitive strengths breakdown are estimates produced from a short adaptive assessment and are not authoritative measurements. They are not a clinical IQ test, not a medical or psychological diagnosis, and not a substitute for evaluation by a licensed psychologist, neuropsychologist, educator, or other qualified professional. You should not rely on BrainRank results to make decisions about employment, admissions, medical care, learning disabilities, or any other matter where a professional assessment is appropriate.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Digital Den LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the App, including loss of data, lost profits, or reputational harm.

Our total aggregate liability arising from or relating to the App will not exceed the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) fifty U.S. dollars (US$50).

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Digital Den LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the App, your violation of these Terms, or your violation of any third-party right.

11. TERMINATION

We may suspend or terminate your access to the App if you materially violate these Terms or use the App in a way that risks harm to other users, to us, or to third parties. You may stop using the App and delete your account at any time from in-app settings. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.

12. CHANGES TO THESE TERMS

We may update these Terms from time to time. Material changes will be communicated through in-app notifications and reflected in the "Last Updated" date above. Your continued use of the App after notice constitutes acceptance of the updated Terms.

13. GOVERNING LAW

These Terms are governed by the laws of the State of Nevada, United States of America, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App will be resolved exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts.
